GENERAL TERMS AND CONDITIONS OF BUSINESS
 
SCOPE
 
The following terms and conditions apply to all orders placed via our online shop by consumers and entrepreneurs. 
 
A consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.
 
These General Terms and Conditions also apply to future business relationships with entrepreneurs without us having to refer to them again. If the entrepreneur uses conflicting or supplementary General Terms and Conditions, their validity is hereby contradicted; they will only become part of the contract if we have expressly agreed to this.
 
CONTRACTUAL PARTNER, CONCLUSION OF CONTRACT
 
The purchase contract is concluded with Fayrouz Group LTD. 
 
The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after the order has been submitted. 
 
When the contract with us is concluded depends on the payment method you choose.
We accept your order by sending a declaration of acceptance in a separate email or by delivering the goods within two days.
 
CREDIT CARD
 
When you place your order, you will also send us your credit card details. Once you have been identified as the legitimate cardholder, we will ask your credit card company to initiate the payment transaction and thereby accept your offer.
 
PAYPAL, PAYPAL-EXPRESS
 
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we ask PayPal to initiate the payment transaction and thereby accept your offer.
 
CONTRACT LANGUAGE
 
The language available for concluding the contract is German.
 
DELIVERY AND SHIPPING CONDITIONS
 
Goods are usually delivered by post to the delivery address provided by the customer. When processing the transaction, the delivery address provided by the seller during the purchase process is decisive. In contrast to this, if the PayPal payment method is selected, the delivery address provided by the customer to PayPal at the time of payment is decisive.
 
For goods delivered by a freight forwarder, delivery is made "free curb side", i.e. up to the public curb closest to the delivery address, unless otherwise stated in the shipping information in the seller's online shop and unless otherwise agreed.
 
If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer bears the costs for the unsuccessful shipment. This does not apply if the customer is not responsible for the circumstances that led to the impossibility of delivery or if he was temporarily prevented from accepting the service offered, unless the seller had announced the service to him a reasonable time in advance.
 
In the case of self-collection, the seller first informs the customer by email that the goods ordered by him are ready for collection. After receiving this email, the customer can collect the goods from the seller's headquarters after consultation with the seller. In this case, no shipping costs will be charged.
 
We do not deliver to packing stations. 
FREIGHT SHIPPING 
 
The goods will be shipped to your home by a freight forwarder.
Shipping costs are calculated depending on your location in the checkout area.
Please ensure that the goods can be received in person at the agreed time on that day to avoid additional costs for you for a further delivery. Delivery is made to the curb and can only take place if the road is suitable for a truck.
 
Please make sure you make arrangements for placement and storage in advance.
 
NOTE ON FREIGHT SHIPMENTS:
 
It is important to us that you receive your goods in perfect condition!
 
Many of our products are very heavy or susceptible to breakage and damage. For transport safety reasons, we also ship smaller order quantities, usually from 1 box, on a pallet with the freight forwarder. We also ship our goods with premium shippers to minimize complaints as much as possible. Even if this is a little more expensive. 
 
Even with the best packaging and safest transport, breakage can occur. In any case, you will receive a free replacement delivery. You can help us with the process if you observe the following points:
 
If goods are delivered with obvious transport damage, please report such defects to the deliverer as soon as possible and please contact us immediately.
If the goods are damaged, please accept them anyway. Unless it is already clear from the outside that ¾ of the goods are completely damaged - in which case you can refuse to accept them.
Transport damage must be reported in writing (email) within 7 days. This way we can guarantee a problem-free replacement delivery.
 
 
Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the freight carrier or transport insurance by telling us the exact amount of damage and sending us photos of the damage.
 
Please ensure that the delivery location has no access restrictions.
 
TRANSPORT DAMAGES
 
The following applies to consumers: 
 
If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and contact us immediately. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the freight carrier or transport insurance.
 
The following applies to entrepreneurs:
 
The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the item to the forwarding agent, the carrier or the other person or institution designated to carry out the shipment. Among merchants, the obligation to inspect and give notice of defects as set out in Section 377 of the German Commercial Code applies. If you fail to give notice as set out there, the goods are deemed to have been approved, unless the defect was not apparent during the inspection. This does not apply if we have fraudulently concealed a defect.
 
SUITABLE FOR OUTDOOR/NON-SLIP/BATHROOM/WET ROOMS
 
Any tiles described/labelled/listed as suitable for outdoor use/non slip/bathroom/wet room are deemed to be suitable by the manufacturer, the suitability of each tile should be checked by a qualified person. Before laying/buying tiles certain factors should be considered whether the subfloor is sound, whether the tile surface is suitable for the purpose i.e. whether the area gets wet, whether the surface is lopsided etc. Our description of "suitable for outdoor use "bathroom" "wet room" ONLY refers to certain tests carried out by the manufacturer. YourTiles.com is NOT responsible for the surface/area that tiles are fixed/fitted to, this is the responsibility of the buyer.

TRADE ACCOUNTS/DISCOUNT CODES

Trade accounts/Discount codes are available at our discretion, Trade accounts/Discount codes can be revoked at any time without any prior notice and/or warning for any reason we deem fit. Any Trade accounts/Discount codes are applied via a discount code and/or are automatically applied. Any Trade accounts/Discount codes may not be available on or during a sale, clearance or reduced products and/or any products we exclude from discounts. 

 
WARRANTY AND GUARANTEES
 
Drawings, illustrations, dimensions, weights or other data in our online shop are non-binding unless we expressly state otherwise.
 
The statutory liability for defects applies. Installation and removal costs resulting from the installation of faulty material are generally excluded from the liability of Fayrouz Group LTD. 
 
Who is liable if different batch numbers are purchased and installed?
 
We try to ensure that we supply you with tiles from only one batch number to avoid any potential problems.
However, the customer or the installer is responsible for checking. You must check yourself whether the tiles you have bought come from the same batch or not. If you lay tiles without paying attention to this beforehand, you will no longer be able to make a complaint later. You will also find a note about this printed on most tile boxes. So make sure you check before laying whether all your tiles come from the same batch.
 
FINAL PROVISIONS
 
If you are an entrepreneur, German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
 
If you are a merchant within the meaning of the German Commercial Code (HGB), a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between you and us is our place of business.
